Withdrawal information (web purchases)

This draft is not the statutory model text; counsel must replace or confirm it word for word.

Applies to consumers who buy a Kidova subscription on kidova.com or app.kidova.com. For purchases in the App Store or Google Play, Apple's or Google's rules apply.

Right of withdrawal

You have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period is 14 days from the day the contract is concluded. To exercise your right of withdrawal, you must inform us ([Company name, address, email withdrawal@kidova.com, phone]) of your decision to withdraw from this contract by a clear statement (e.g. a letter sent by post or an email). You can use the attached model withdrawal form, but this is not required. You can also withdraw using the electronic withdrawal function on our website and in the app: button "Vertrag widerrufen" ("Withdraw from contract"), then "Widerruf bestätigen" ("Confirm withdrawal"). [Counsel: exact statutory wording] To meet the withdrawal deadline, it is enough that you send your notice before the withdrawal period has expired.

Consequences of withdrawal

If you withdraw from this contract, we will reimburse all payments received from you without undue delay and at the latest within 14 days from the day we receive your notice of withdrawal. We use the same means of payment you used for the original transaction, unless expressly agreed otherwise; you will not be charged any fees for this reimbursement. If you requested that the service begins during the withdrawal period, you must pay us a reasonable amount corresponding to the proportion of the service provided until you told us of the withdrawal, compared with the full scope of the contract. • Before payment: show this information and a checkbox/declaration where the consumer expressly requests the service to start before the end of the withdrawal period [and acknowledges consequences, counsel].
• After purchase: send the contract confirmation incl. this information on a durable medium (email/PDF).
• Electronic withdrawal function (§356a BGB): a clearly labelled button "Vertrag widerrufen" available throughout the withdrawal period (Kidova knows each contract's date, so availability can be limited per contract; if identification is not possible, keep it permanently available). Second step "Widerruf bestätigen"; then immediate confirmation of receipt on a durable medium (email) with date and time.
• Different from the cancellation button (§312k BGB, "Verträge hier kündigen"), which must also exist (terms §9).
