- Contract terms and automatic renewal. KIDOVA.md §19.3 plans monthly, yearly and 2-year plans with renewal at the same price. For consumers in Germany, §309 No. 9 BGB (since 1 March 2022) allows an initial term of up to 2 years but a tacit renewal only for an indefinite period, terminable at any time with at most one month's notice. A renewal "for another year" is therefore likely invalid for German consumers on web contracts. This draft uses: initial term = the chosen plan period; afterwards the contract continues indefinitely at the same price per period, terminable monthly. Counsel to confirm and to check how this interacts with store subscriptions (App Store / Google Play), where the store's terms govern billing.

1. Scope and provider
These terms apply to contracts between [Company name, legal form, address] ("Kidova", "we") and you as the account holder ("you"). Kidova offers its service to adults (18+) who hold parental responsibility for the children they protect or who use Kidova for themselves. Children do not enter into contracts with us.
2. The service
Kidova provides:
- Kidova VPN: an encrypted WireGuard tunnel to servers in Germany.
- Kidova Shield: category filtering, SafeSearch and YouTube Restricted Mode, schedules, pause, app limits, access requests for child profiles.
- Kidova Clean: blocking of ads, trackers, malware and phishing domains where the platform allows it. In the Google Play version, ad blocking is not available, because of Google Play policies. On iPhone, ad blocking inside the app depends on Apple's review.

3. What Kidova cannot do (important)
- Kidova blocks by domain and IP address. It cannot remove ads that platforms show inside their own apps and feeds, for example YouTube, Instagram, Facebook or TikTok sponsored posts, because these come from the same servers as the content.
- No filter is perfect. Some unwanted content may get through and some harmless sites may be blocked. You can allow sites and report wrong blocks.
- A determined user with full control of a device, a second device, or a factory reset can bypass protection. Kidova tells you when protection on a paired device stops (tamper alerts), but cannot prevent every bypass.
- Kidova is not a replacement for parental supervision and conversation.
4. Filtering and content restrictions
Kidova restricts access to online content according to the categories and rules the account holder sets. Categories and lists are maintained by Kidova and third-party sources (docs/list-licenses.md). Decisions are automated. You can appeal a block via "Report wrong block"; we aim to review reports within 24 hours [confirm service level].
5. Your obligations and fair use
You may only protect:
- devices used by children for whom you hold parental responsibility (or have the consent of the person who holds it), and
- your own devices, or devices of other adults only with their informed consent.
Using Kidova to monitor another adult without their knowledge is prohibited and may be a criminal offence. We may suspend accounts that do so.
You must not use the Kidova VPN for illegal activity, sending spam, attacking systems, or infringing copyrights. Outgoing email on port 25 and peer-to-peer file sharing are blocked. We may limit bandwidth for use far above normal family use

6. Account and security
Keep your login (passkey, email access) secure. Co-parents you invite can manage profiles according to their role. You are responsible for who you invite.
7. Prices and payment
Prices include VAT. Prices by country: kidova.com/pricing.
- Web purchase: billed by Kidova via our payment provider (for example Stripe). You receive an invoice.
- In-app purchase: billed by Apple or Google under their terms. Refunds for in-app purchases are handled by Apple or Google.
- Price lock: the price you signed up at stays the same for renewals of the same plan

8. Term, renewal, termination

- After the first term, the contract continues for an indefinite period at the same price per billing period; you can cancel at any time with one month's notice.

On kidova.com and app.kidova.com, a button labelled "Verträge hier kündigen" ("Cancel contracts here") is shown permanently and is easy to find (footer of every page and in Billing).

- The button leads to a confirmation page that works without logging in

- information to identify you (name, email of the account);
- information to identify the contract (e.g. plan, order number, optional);
- the time the termination should take effect (default: "as soon as possible");
- an email address for the confirmation.
- A button labelled "jetzt kündigen" ("cancel now") submits the termination.
- You can save the submitted termination with date and time (download/print view).
- We send an immediate confirmation by email (text form) with the content, date and time of the termination and the date on which it takes effect.
- If we cannot identify the contract, we still confirm receipt and contact you. The same flow is reachable in the app for web contracts. Store purchases are cancelled in the store; the app links there.
10. Right of withdrawal
Consumers have a statutory right of withdrawal. See the withdrawal information (docs/legal/en/withdrawal.md), including the electronic withdrawal function ("Vertrag widerrufen" → "Widerruf bestätigen", §356a BGB). In addition, we offer a voluntary 30-day money-back guarantee on web purchases (KIDOVA.md §19.2) [define conditions; must not restrict statutory rights].
11. Availability and changes to the service
We aim for 99.9 % gateway availability per month [counsel: target, not a guarantee; or SLA terms]. Maintenance is announced on status.kidova.com. We may change features if the change is reasonable for you, for example to comply with app store rules or law; we inform you in advance [align with §327r BGB for digital products; counsel].
12. Liability
We are liable without limitation for intent and gross negligence, for injury to life, body or health, under the Product Liability Act, and under a guarantee. For slight negligence we are liable only for breach of essential contractual obligations (obligations whose fulfilment makes the contract possible and on which you may rely), limited to the typical, foreseeable damage. 14. Consumer dispute resolution

15. Final provisions
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law does not remove the protection of mandatory provisions of the law of the country where they habitually reside.
